These Terms of Service ("Terms") are a binding agreement between you and Conceptos Design LLC, a Nevada limited liability company with a mailing address at 2701 Northgate Ln, Ste 2, Carson City, NV 89706 ("Company," "we," "us"). By accessing or using Apex at www.apexformarketers.com ("Apex" or the "Service"), including by sending any message to Apex, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use Apex.
Apex is an AI-powered marketing assistant. Responses are generated by artificial intelligence based on the information you provide. Apex is a software tool, not a person, and no output creates a consulting, agency, fiduciary, or professional-client relationship between you and the Company.
AI-generated content can be inaccurate, incomplete, or out of date. You agree that:
Apex asks for your first name and email address before the conversation begins. You agree to provide accurate information and to keep it current. We may set usage limits (including message rate limits), and we may suspend, restrict, or terminate access to the Service at any time, with or without notice, including for conduct that violates these Terms.
You agree not to:
The Apex platform, including its software, prompts, frameworks, methodologies, branding, and content (other than your inputs), is and remains the exclusive property of Conceptos Design LLC. No ownership rights are transferred to you by using the Service.
You retain ownership of the information you submit to Apex. Subject to these Terms, you may use the outputs Apex generates for you in your own business, including commercially. You may not claim that the Apex platform itself, or its frameworks, are your own.
Core access to Apex, including The Apex Discovery, is free. Certain experiences are paid, one-time purchases at the prices displayed at checkout, currently The Apex Formula ($47) and The Apex Funnel ($197). Prices may change at any time; the price shown on your order form at the time of purchase is the price you pay.
Payments are processed through our hosted order forms and payment processors. Paid experiences are digital services delivered through the Apex chat interface. You may cancel a purchase by emailing s@stevelemus.com within three (3) days of purchase for a refund, unless you have already substantially received the deliverable (for example, your funnel pages have been generated or your content calendar has been delivered), in which case all sales are final except where required by law.
Some experiences guide you in setting up accounts and services with third parties (for example, domain registrars, hosting, payment, and email providers). Any fees charged by those third parties, such as your domain name, are your responsibility and are not collected by us. Consulting engagements, courses, done-for-you builds, and other services offered by the Company are governed by separate agreements and the terms at stevelemus.com/terms.
Our collection and use of your information, including your chat messages, name, and email address, is described in the Apex Privacy Policy. By using the Service you consent to that collection and use, including the processing of your messages by third-party AI service providers to generate responses.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCEPTOS DESIGN LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Conceptos Design LLC from and against claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its rules, before a single arbitrator, in Carson City, Nevada. Claims relating to intellectual property or confidentiality may instead be brought in court. You and the Company each waive the right to a jury trial and to participate in any class or representative action.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Subject to Section 12, exclusive venue for any permitted court proceeding lies in the state courts of Washoe County, Nevada, or the U.S. District Court for the District of Nevada. The prevailing party in any proceeding is entitled to recover its reasonable attorneys' fees and costs.
We may modify these Terms at any time by posting an updated version at this page with a new effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is held unenforceable, the remainder stays in full force. These Terms, together with the Apex Privacy Policy, are the entire agreement between you and the Company regarding the Service and supersede any prior understandings. Electronic acceptance of these Terms is valid under the federal E-SIGN Act and Nevada law.
